Prosecutors to Announce Decision on Possible Resentencing for Erik and Lyle Menendez


In 1996, brothers Erik and Lyle Menendez were sentenced to life in prison without the possibility of parole. Los Angeles County District Attorney George Gascón has scheduled a news conference at 1:30 p.m. to discuss his office’s decision regarding their possible resentencing. If prosecutors recommend resentencing, it will still require court approval. 


Lyle, 21, and Erik, 18, at the time of the crime, admitted to fatally shooting their father, Jose Menendez, an entertainment executive, and their mother, Kitty Menendez. The brothers claimed they acted out of fear, believing their parents were going to kill them to prevent anyone from discovering that Jose Menendez had sexually abused Erik for years.


Over the years, members of their extended family have called for their release, arguing that after decades behind bars, they deserve a second chance. They’ve also pointed out that in today's society, which is more aware of the impact of sexual abuse, the brothers likely wouldn’t have been convicted of first-degree murder or given life sentences.


The Menendez brothers faced two trials for the murders of their parents, with the first ending in a hung jury. During the trials, prosecutors argued there was no solid evidence of abuse, and many details of the brothers' claims of sexual molestation were not allowed in the second trial.
